    This Privacy Policy applies to the collecting, processing, and use of personal data in the context or on the occasion of your visit to the websites accessible under http://www.manufactum.co.uk/ (hereinafter "websites"). The Privacy Policy is also in effect when you order something via mail or fax if the order form there is explicit reference to this Privacy Policy statement.

    As defined by the UK Data Protection and consumer legislation, Manufactum Ltd., P.O. Box 45, Bedford, MK40 2WH (hereinafter "Manufactum", "we", "us" or "our") is the websites service provider, which you always may contact with any concerns or suggestions on the subject of data privacy by using the contact information provided in the Editorial Information or at the end of this Privacy Policy.
    I. Which of your data do we collect, process, and use and for what purpose?
    With this Privacy Policy, we would like to give you a better understanding of what happens with your data when you visit our websites, order via these or use or request other options or offers (e.g. sign up for a newsletter).
    1. Technical Data
    We are aware that you, as a visitor to our websites, expect not only a high standard of quality of our products but also a high standard of quality of handling your data. Nowadays, it is not possible anymore not to use technical tools while providing a website. When you use our websites, we inevitably collect information from you, even if you do not send this information actively to us. We thus receive different technical information when you visit our websites. This includes, for example, IP-Address of your device and/or your internet connection, date and time of your visit to our websites, browser type that you use, the browser settings and the operating system, and the data volume transferred (hereinafter "technical data"). With the use of our websites, you agree and consent that we are allowed to collect, process and use technical data from you.
    2. Basic Data
    For the purposes stated below, we collect the following data from you (so-called "basic data").
    a. Orders
    When you send us, for instance, an order, a range of your personal data will be collected, processed and used by us. This data will be necessary to carry out your order. We limit the data gathered thereof to the minimum necessary for the fulfillment of the contract, in particularly surname, given name, street, house number, postal code, city, phone, email, bank account details, and, if necessary, date of birth.
    When you order items from our online shop that require a proof of age, you will be reminded in the order confirmation to provide this confirmation. In this case we will ask you to send a photocopy of your ID card, on which all details other than name, address, date of birth and ID validity have been blacked out. We will then ask you to send this copy via a secure route (encrypted email, fax or by post). After registering the proof of age we will destroy the copy in conformity with data protection requirements.
    b. Services on our websites
    Insofar as we are offering other services besides product ordering service on our websites you can also provide us with your data. This applies for the following services for that the types of data described below will be required:
    Activation of an user access and creation of a customer account Mandatory Information to be provided: Basis data as described in paragraph a. above.
    Ordering Manufactum Catalogues (product catalogue, garden catalogue, clothes catalogue, MAGAZIN catalogue).
    Mandatory Information to be provided: Surname, given name, address.
    Ordering newsletters: With our newsletters you receive our offers before these are published in our printed catalogues and occasionally also special offers. Mandatory Information to be provided: email.
    Using the feedback function: Our customers are most likely those who can help us to improve. That is why we make it possible for you to send us a feedback with your suggestions or criticism anytime by using our form on our website in the section "Feedback". Mandatory Information to be provided: Your feedback along with your email.
    Other contact: Furthermore, on our websites we offer you the option to contact us via online form.
    Mandatory Information to be provided: Basic data as described in the paragraph a, theme selected by you and your message as well as your country.
    c. Consent wording
    When you have transferred to us the data indicated in sections a. and b. for the purpose explained there, when you have submitted – with the exception of the separate order of our Newsletter – the following declaration of consent:
    I have read the Data Protection Declaration and I agree to it, i.e. in particular, I agree that my data - as it has been explained here - will be collected, processed and used.
    With that you have agreed that we are allowed to collect, process, and use your data, as this is explained in this Privacy Policy. In case if you have given your consent in connection with a separate subscription to our newsletter via our websites, you have also consented that we are allowed to use your email address for sending you email advertisements.
    As far as you have ordered our newsletter not separately via our websites, but additionally in connection with other services of our websites (e.g. by ordering catalogues or signing up for a customer account), you have declared the following consent:

    With your agreement you have also given us permission to use your email address to send you advertising.
    If however you have ordered the Newsletter separately from our website, you have only submitted the following declaration of consent:

    You have thereby given your consent to us to collect, process and use your data as specified in the data privacy statement, and have given us your consent to send you our Newsletter with advertising offerings at the email address you have indicated.
    d. Withdrawal of consents
    You can withdraw consents which you have given via our websites at any time without any form requirement and with effect for the future by sending an email to info(at)manufactum.co.uk or a letter to

    The revocation of your consent does not cause any costs, with the exception of possible forwarding and connection fees.
    Without your consent we will not use your data for the purposes for which your consent is required. This applies equally when you withdraw your given consent at a later point.
    However, we would like to point out that regarding the use of so-called Cookies on our websites, the data which especially refer to your surfing behavior can be analyzed without your expressed consent for the purposes of marketing and website optimization in pseudonymous or a non-personalized form. For more details, please refer to the explanations in Subsection 3. There you also will find the information on how you can prevent such analyses of your data.
    Despite of your right to withdraw consents given with effect for the future, you can object to the use of your data for the purposes of marketing. Please follow the procedure as described in Section II.
    Lastly, we would like to inform you that you can unsubscribe from any newsletter here on our website or by clicking the link "Unsubscribe" in the footer of each newsletter.
    3. Usage data
    a. For what purpose do we use your usage data
    Furthermore, we receive the information about your usage behavior, i.e. how you used our websites or newsletter, for example, what you found interesting on our website or in the newsletter and whether and what have bought, but also the website which you last visited (hereinafter "usage data"). By using our websites and newsletter, you agree that your usage data may be collected, processed and used as described below.
    We use your usage data to design our websites and to optimize them as well as to present our offers to you in a better way. The usage data are initially collected in so-called usage profile pseudonymously, it means that your usage data are not stored under your real name, but under a pseudonym (for instance, by using the number). In case that we have already received basic data from you that enable us to identify your person (for example, because you have registered for our web store, subscribed the Manufactum catalogues or ordered the products from us so that we have your name and address), it is possible that we merge your pseudonymized usage profile with your basic data, order and technical data as well as with the information about your service requests in order to be able to send you offers (for example, per email) specially designed for you.
    b. How do we receive your usage data?
    The pseudonymized usage profile is created by using so-called cookies und tracking pixel. Cookie is a small text file placed by our websites locally on your device (for example, PC, Tablet, or Smartphone) to be held for a later retrieval. This enables us to recognize your browser at a later visit. Tracking pixels, however, are small image files that are integrated mainly into our newsletters and help us to determine whether you have opened a newsletter. For this reason, we use also third-party tools and technologies as described in Subsection bb. below.
    aa. How can you in generally object to the collection of usage data?
    As stipulated by law, you have a right to object in relation to the use of cookies as well as of tracking pixels. You can generally object to the use of the cookies and tracking pixel with the effect for the future, as far as these are used to record and analyze your usage behavior. You can object by using a so-called "Adblocker", by installing expansions (so-called "Add-ons") for your browser that with an appropriate configuration can impede that your usage behavior will be recorded by us. Please note that it possible that an AdBlocker must be specially configured if this shall block cookies and/or tracking pixel originated by us. For more detailed information in this regard, please refer to the Help option or user information of the respective AdBlocker used by you. AdBlockers are mostly available for free for all common web browsers. You can find detailed information regarding these topics by typing "Adblocker" and your browser type into a common search engine.
    Furthermore, you can use the preference management of the website of EDDA AisBL, a non-profit association established in Belgian law, to find out, what cookies from participating standard providers are installed on your device that may collect your usage behavior for the purpose of Online Behavioral Marketing.     Please note that not all of our websites' functionalities may be available if your web browser does not accept cookies from our websites. This is due to the reason that we also use cookies to optimize our websites, e.g. to improve the search functionalities so that you may receive requested information faster. Furthermore, we use cookies in order to support and simplify the ordering process on our websites so that problems may arise in connection with the ordering process in case your web browser generally rejects cookies from our websites.
    bb. What third party technologies do we use and how can you object?
    In order to collect your usage data we also use the following solutions and technologies from third party providers:
    (1) Microsoft Bing Ads und Google AdWords
    On the one hand we use the product "Bing Ads" of Microsoft Corporation, One Microsoft Way, Redmond, WA 98052-6399, USA (hereinafter "Microsoft"). On the other hand we use Google AdWords, a product of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, USA (hereinafter "Google").
    Both products use the so-called Conversion Tracking Technology. This technology sets a cookie on the device of such visitors of our websites that reach our websites through clicking an advertisement of Microsoft Bing or Google. In case that Microsoft's Bing advertisements are concerned the cookie originates from Microsoft, in case that Google's advertisements are concerned it originates from Google. Each of both cookies is effective for 30 days.
    As long as these cookies are in effect Microsoft, Google and we are able to determine that a user has clicked on such an advertisement and reached the website previously defined. When reaching our websites on the device of such visitors a tracking-pixel will be set that enables us to determine whether the visitor has issued an order and, if so, to what order value. We thereby do not receive any information regarding the identity of respective website visitors; rather, we only get information about the total number of visitors that have been redirected to our conversion-site through a Bing or Google advertisement as well as potential order values. Please note that these data protection information are independent from ours and that we are therefore neither responsible nor liable for these.
    If you want to avoid the use of tracking pixels on our websites which enable us to determine whether you have issued an order on our websites and to what order value after having clicked our Microsoft Bing's or Google's advertisement you can object here at any time with effect for the future. To avoid that Microsoft Bing or Google themselves store cookies on your device while you are clicking on our Microsoft Bing or Google advertisements, please follow the instruction under Subsection aa. above.
    (2) Econda and optivo
    For the purposes described in Subsection a. above we also use technologies of econda GmbH, Eisenlohrstraße 43, 76135 Karlsruhe (hereinafter "Econda"). In this context Econda creates a pseudonymized usage profile as described in detail under Subsection a. above. The pseudonymized usage profile created by Econda will be matched with basis data, ordering data and technical data as well as with information about your service requests as described in Subsection a. above if you have declared your consent to this Privacy Policy. Irrespective from this you can object to the data collection and storage by Econda here (external link) at any time effective for the future. In this case, please follow the onscreen instructions and ensure that your web browser does not delete Econda's Opt-out cookie "econdaNoTrack" that is set by Econda if you object.
    Furthermore, we use Econda in order to track in what offers you have been interested in if you receive our newsletter and reach our website by clicking on pictures or links implemented in the newsletter. You can object to this data collection and storage by Econda here (externer Link) at any time with effect for the future.
    We also use optivo Broadmail, a product of optivo GmbH, Wallstraße 16, 10179 Berlin (hereinafter "optivo") in order to receive information whether you receive our newsletters, open these and click on offers included therein. In order to ensure that our newsletters are displayed optimally, we store information related to your device including your email client and operating system in this context. If we have optivo instructed to do so, optivo will transfer the respective data to further service providers that may support us in analyzing these data after we have obliged these specifically to data privacy (in this context please also note Section III. below). By collection and analyzing usage data with regard to our newsletters we want to ensure that were are able to optimize the newsletters on a continuous basis and that their design is in line with your individual interests.
    If you want to avoid that we collect, process and use your usage data regarding our newsletters as described above, please take the following action which prevent that we and our service providers receive the following information:

    Your surfing behavior on our websites after having clicked on an offer within a newsletter
    1. Change your browser settings in a way that it does not store cookies. You can find detailed information for this in the help function of your browser. Please note that not all functions of our websites may be available if your browser does not accept cookies.
    2. Alternatively you can object to the collection of your surfing behavior here (external link).
    Device used including email client and operating system Deactivate the picture download function of your email client and avoid to click on pictures and links within our newsletters. Please note that we will nevertheless receive information about the operating system of your device in case that you visit our websites.
    4. Ordering Data
    Finally, we also store and use data with regard to the orders placed by you (what have you ordered, when, for what price and how did you pay).
    II. Marketing and your Right to Object
    We also use the above described technical data, basis data, usage data and ordering data as well as your service requests that we for example may receive if you use the feedback function on our websites for marketing purposes. We do that in order to improve our product assortment and our online ordering service and to address you for example via mail or electronically, for example via email, with individualized product information (please also note our information in Section I., Subsection 3a.). As part of so-called customer segmentation, this makes it necessary to assign you to a categorized group of customers (e. g. "regular customer").
    If you want to avoid that we use your data for these purposes, you can object to this use at any time with effect for the future by sending us an informal letter to Manufactum Ltd., P.O. Box 45, Bedford, MK40 2WH or an email to: info(at)manufactum.co.uk. After you have objected, your data may be used only in an anonymous form for marketing purposes. In such case, personalized information regarding your person will only be used to process your orders and will be blocked for other purposes. Therefore, please note that we are then no longer able to send you any catalogues.
    Please note that you have to object separately to the use of your usage data for marketing purposes due to technical reasons. In this matter, please follow the instructions as stated in Section I, Subsection 3b above.
    If you like to unsubscribe from our newsletters and withdraw your respective consent or if you like to withdraw your consent in terms of the use of your data for marketing purposes in general, please follow the instructions in Section I, Subsection 2d.
    III. Receive external parties your data?
    Due to the complexity of data processing nowadays, we use external service providers which support us in this matter. On the one hand, we are using these regarding the collection and analysis of your usage data as described in Section I, Subsection 3b bb above. On the other hand we are using external service providers for usual IT services.
    Currently, Manufactum is supported by MCS Moorbek Computer Systeme GmbH, Essener Bogen 17, 22419 Hamburg and arvato systems Technologies GmbH, Carl-Bertelsmann-Str. 50, 33311 Gütersloh, which are storing your data and all voluntary information you provide to us, update these after respective notifications and keep these available for us. Due to the reason that Manufactum has the status of a controller regarding your data, we are still responsible for its security. Besides of that, MCS Moorbek Computer Systeme GmbH and arvato systems Technologies GmbH Manufactum were contractually obliged by us to implement effective measures to ensure the security of your data. In this context, we are in close connection with the data protection officers of MCS Moorbek Computer Systeme GmbH and arvato systems Technologies GmbH. Please note that it is possible at any time that we will change these service providers.
    If and as far as we should use further or other service providers which store and process data on our behalf, these will also be binding integrated in our security concept. Apart from that, basically, we disclose your data only if this required for the justification, execution or termination of a contract with you, e.g. to logistics companies, if you have been purchased from us.
    A disclosure of your data is further possible if we have a concrete reason to believe that your basic data were used to commit a crime (e.g. fraud) against us (hereinafter "suspicious case"). For such suspicious case, we reserve the right to disclose your data to law enforcement authorities (especially Police and Prosecution Office), especially in connection with reporting an offence. We also reserve this right if a law enforcement authority asks us to reveal information regarding your person. Furthermore, we reserve the right to terminate your customer account and exclude you from further orders if a suspicion case is given.
    Finally, it is possible that we reveal your data to third parties, especially members of the Otto Group, for marketing purposes, this, however, only in an anonymous form.
    A disclosure of your data to other external parties does not take place.
    IV. How secure are your data?
    To ensure that no personal information get lost during the transmission modern SSL encryption technologies do apply. Depending on the browser used by you encryptions and key lengths up to 256 bit are possible.
